High Point Uptown Apartments Litigation Support
High Point Uptown Apartments is a luxury residential complex consisting of two apartment buildings encompassing 277 units and including a parking garage, plaza, pool, fitness center, and courtyard. As construction progressed, the original schedule milestones slipped due to a variety of reasons, including weather delays. There were also allegations of construction defects in the completed work, including issues with the load bearing walls and lateral load resisting system.
Ultimately, the managing partner of the development team terminated the general contractor when the project had reached approximately 75% completion and retained a replacement general contractor to finish the project. Following termination of the original general contractor, a dispute arose regarding the final value of the construction contract accounting for work-inprogress, punch list items, and alleged construction defect items.
